Voxie Recommended SMS Marketing Consent Collection, Terms of Service, and Privacy Policy Language

This information is not legal advice. While we do our best to provide useful information to use as a starting point, Voxie advises all customers to obtain professional legal advice to ensure that marketing campaign are sent in full compliance with applicable laws.

In this article, we’ll walk you through adding the necessary compliance text to your site, and the key elements to include in your Terms of Service and Privacy Policy, along with examples. The example provided should be additions to your existing Terms of Service and Privacy Policy, and relate only to text marketing.

If you already have a Terms of Service and Privacy Policy page on your website, make sure they include all elements listed below. If you do not plan to incorporate abandoned cart/abandoned checkout messaging strategies in your SMS marketing program, you may remove the language in the SMS marketing consent collection, Terms of Service, and Privacy Policy sections that refer to this.

These are the key elements necessary for a compliant SMS marketing program. Please contact us at Support@voxiechat.com if you have any questions.

SMS Marketing Consent Collection

When obtaining consent for SMS marketing, you must familiarize customers with your Terms of Service and Privacy Policy. According to industry guidelines, links to those pages along with information about opting out, receiving help, and applicable fees should be included in the compliance text that accompanies any field where contact information is collected for the purposes of SMS marketing.

This information should be provided clearly and legibly on your website, placed in the same area you are collecting SMS marketing consent (e.g. beneath the mobile phone number entry field, next to the form’s “Submit” button).

Example

By signing up via text, you agree to receive recurring automated marketing messages, including cart reminders, at the phone number provided. Consent is not a condition of purchase. Reply STOP to unsubscribe. Reply HELP for help. Message frequency varies. Msg & data rates may apply. View our Privacy Policy and Terms of Service.
